Each project that is conducted under the FIDIC Contract gives rise to new issues and applications as the work has been completed under the new contracts. This workshop, now conducted annually, will serve both as a refresher and update for those who attended the course in the last few years, and as new exposure for those who did not. Workshop Content

This workshop will trace the contractual process from pre-tender stage to taking over, where the FIDIC contracts are used. The New Engineering Contract and FIDIC have had adjudication procedures in place for some years, and some international jurisdictions have introduced legislation supporting adjudicating.
We have already seen a surge in the use of the adjudication process, yet few members of the construction industry understand the process or appreciate how it differs from conventional forms of dispute resolution.

Most members of the construction industry are unclear as to what adjudication is, how it is applied, and how it differs from other forms of dispute resolution. Lawyers and construction personnel alike do not fully understand this form of dispute resolution and there are few people who understand the process sufficiently well to act as adjudicators.

To assist potential users in preparing for adjudications, BCA offers a one day seminar which introduces the concept, shows how it differs from other forms of dispute resolution, and discusses the adjudication provisions in current standard forms of contract. In this seminar we will also take a step-by-step walk through the adjudication process, following the process from beginning to end.

Six years since it first launched its new edition GCC contract, the GCC drafting committee launched its second edition early in June 2010. The GCC 2010 contract will be familiar to those used to the 2004 edition but includes some interesting innovations including:

• The contract is suitable for use in disciplines other than civil engineering. The new contract is suitable for building works, civil engineering works and electrical and mechanical works. GCC has recognised that multidisciplinary projects are often best served by a multi-disciplinary contract;
• The contract is suitable for employer designed and contractor designed works;
• The contract has received the CIDB tick of approval and meets CIDB best practice requirements.
BCA envisages that the wider ambit of the new GCC will mean increased take up of this contract. Contractors and clients from the building environment who in the past would not have looked to GCC may now consider it for their building projects. Those looking for a local contract for multi-disciplinary projects will also look to the new GCC.

One of the major advantages of the NEC suite of contracts is its ability to provide a range of procurement options. Contractors should be aware that it is not necessarily in their best interest to apply the procurement option imposed upon them by the Employer in the sub-contract environment and that considerable advantages may be achieved by varying the option under which the Sub-contractor is appointed. This seminar will look initially at contract strategy from the perspective of main Contractor/Sub-contractor appointment. Thereafter the seminar will deal with that most difficult area under the NEC, change management systems, which will embrace dealing with variations and extensions of time. The final session of the day will look at common changes made by Employers to the Conditions of Contract through the Z clauses and their impact and particular reference will be given to limitations of liability and force majeure.
